Services Overview

Welcome to Pixtara, a platform provided by Linksoft Technologies Inc. (“Pixtara,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website and platform located at [www.pixtara.com] (the “Platform”), including related applications, products, and services. By accessing or using our services, you agree to these Terms. If you disagree with any part of these Terms, you must not use the Platform.

Pixtara facilitates global talent acquisition and staffing through the following services:

  • Offshore Staffing: Hiring talent as an Employer of Record (EOR) or contractors, managing payroll, compliance, and deployment for remote work.
  • Contract-Based Staffing: Providing offshore resources to work on a contract basis, with all employment logistics handled by us.
  • Full-Time Placement: Enabling clients to directly hire candidates for permanent roles, where Pixtara assists with sourcing and vetting.
  • Platform Features: The Pixtara Platform allows clients to post job requirements, review shortlisted candidates with vetting reports, and manage the hiring process.

We connect hiring organizations (“Clients”) with offshore resources (“Talent”), providing a seamless experience for global hiring needs.

Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are liable for all activity conducted under your account. Notify us immediately of any unauthorized access or security breaches.

Client-Specific Terms

Offshore Staffing & EOR Services

  • Clients engaging Pixtara for offshore staffing or EOR services agree to provide accurate job descriptions and requirements.
  • Pixtara will manage payroll, compliance, and employment logistics for offshore resources deployed to Clients.

Contract-Based Staffing

  • Pixtara will provide vetted Talent for contract work, ensuring compliance with local laws. Clients remain responsible for the management of the Talent’s day-to-day activities.

Full-Time Placement Services

  • Clients agree to pay Pixtara a placement fee for full-time hiring. Placement fees are based on a percentage of the Talent’s first-year annual compensation and are due within 30 days of the candidate’s start date.
  • If a hired candidate leaves or is terminated within 90 days, Pixtara will provide a replacement or refund the fee (subject to conditions outlined in the service agreement).

Non-Solicitation

Clients agree not to directly solicit or hire Talent discovered through Pixtara, except through our Platform. Violation of this clause will result in a penalty equal to the applicable placement fee.

Confidentiality

All information shared between Pixtara, Clients, and Talent is confidential and must not be disclosed to third parties without prior written consent.

Disclaimer of Warranties

  • The Website, platform and its content are provided “as is” and “as available,” without warranties of any kind, express or implied.
    We do not warrant that:

    • The Website will meet your expectations or requirements.
    • The Website will operate without interruptions or errors.
    • Any information on the Website is accurate, complete, or up-to-date.

    You use the Website and platform at your own risk. We disclaim all liability for any damages resulting from your use of, or inability to use, the Website.

Limitation of Liability

  • To the fullest extent permitted by law:

    • Pixtara is not liable for any indirect, incidental, or consequential damages arising from the use of the Platform or services.
    • Our total liability will not exceed the amount paid by the Client for the specific service giving rise to the claim.

Termination

  • We reserve the right to suspend or terminate access to the Platform for any violation of these Terms.
  • Termination of services does not absolve the Client from payment obligations for services rendered.

User Content

You may be allowed to submit information or content (such as job postings, resumes, or comments) on the Website. By submitting any content:

  • You warrant that you have the legal rights to provide the content and that it does not violate any applicable laws or third-party rights.
  • You grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and distribute the content for purposes related to our services.

We reserve the right to remove or refuse to post any content that violates these Terms or is deemed inappropriate.

Intellectual Property

All intellectual property rights, including copyrights, trademarks, logos, and trade names displayed on the Website, are owned by or licensed to Linksoft Technologies Inc. and are protected by applicable intellectual property laws.

You may not:

  • Copy, reproduce, distribute, or create derivative works from any part of the Website without our prior written consent.
